Trademark and Copyright Information

The Brutal Honesty name, logo, stylization, visual aesthetic, taglines, and motto (“The truth looks good on you”) are both copyright and trademark protected. All Brutal Honesty content, including brand origination and expansion, as well as brand collateral that identifies the Brutal Honesty brand, have been fixed in a tangible medium as of December 4, 2025. The Brutal Honesty brand package (name, logo, etc.) has also been first used in commerce as of December 8, 2025. No use of the brand image, logo, taglines, visual aesthetic, motto, or other identifying components is permitted without the express written consent of the brand creator and owner, except as outlined below.

Whiny the Poop is a mascot character created for commercial use by Brutal Honesty and the brand’s creators/owners. Whiny the Poop has been fixed in a tangible medium as of December 31, 2025, and has been first used in commerce as of that date. No use of Whiny the Poop, its image, logo, taglines, visual aesthetic, motto, or other identifying components is permitted without the express written consent of the creator and owner, except as outlined below.

The Brutal Honesty brand and Whiny the Poop were created by Jennifer S. Gemmell-Adams of Myrtle Beach, South Carolina, and the brand and mascot character are currently owned by same. This brand’s identity was co-created with “Ivy,” a personal AI assistant or iteration of a large language model that interacts with Jennifer Adams. Product imagery has been created by the production partner for that particular item (i.e., Printify) or created by using an AI image generator (OpenAI’s SORA) with creative prompts provided by Jennifer Adams either individually or with prompt refinement assistance by Ivy.

Use of Brand Imagery and Other Brand Identifiers

An individual may use a screenshot of Brutal Honesty branded products, websites, web pages, content, or other collateral without express written consent of the brand creator only for the purpose of posting said screenshots or images to that individual’s social media accounts or via text to other individuals. This use may not be for-profit, and any profits generated by anyone using brand identifying content specific to Brutal Honesty must immediately be remitted to the brand creator, Jennifer S. Gemmell-Adams. Failure to compensate the brand creator and owner for profits through use of brand specific collateral, products, content, or imagery immediately subjects the infringing individual, business, or entity to treble damages as determined by a court of the brand creator’s choice. These damages also include all costs associated with retaining counsel and filing all legal documentation.
